A new draft law that would change the minimum age for administrative¹ detention² from 16 to 14 has been met with both concerns of overcorrection and voices of support, albeit³ cautious.

The draft law comes in response to rising concerns about young offenders⁴, especially those involved with bullying⁵ or violence at school. 

青少年违法犯罪人员，尤其是在校园里有欺凌和暴力行为的青少年，引发越来越多的关注，该草案的出台是对这一现象的回应。

 

行政拘留（administrative detention）是公安机关对违反行政法律的人，在短期内剥夺其人身自由的一种行政处罚。行政拘留是最严厉的一种行政处罚，通常适用于严重违反行政法律但不构成犯罪（this punishment is applicable to offences that severely⁶ violate administrative law but don’t constitute criminal charges），而警告、罚款不足以惩戒的违法行为。行政拘留期限一般为10日以内，较重的不超过15日。
