MULIER. A woman, a wife; sometimes it is used to designate a marriageable virgin3, and in other cases the word mulier is employed in opposition4 to virgo. Poth. Pand. tom. 22, h. t. In its most proper signification, it means a wife.
2. A son or a daughter, born of a lawful5 wife, is called filius mulieratus or filia mulierata, a son mulier, or a daughter mulier. The term is used always in contradistinction to a bastard6; mulier being always legitimate7. Co. Litt. 243.
3. When a man has a bastard son, and afterwards marries the mother, and has by her another son, the latter is called the mulier puisne. 2 Bl. Com. 248.
MULTIFARIOUSNESS, equity8 pleading. By multifariousness in a bill, is understood the improperly9 joining in one bill distinct matters, and thereby10 confounding them; as, for example, the uniting in one bill, several matters, perfectly11 distinct and unconnected, against one defendant12; or the demand of several matters of distinct natures, against several defendants13 in the same bill. 2. In order to prevent confusion in its pleadings and decrees, a court of equity will anxiously discountenance this multifariousness. The following case will illustrate14 this doctrine15; suppose an estate should be sold in lots to different persons, the purchasers could not join in exhibiting one bill against the vendor16 for a specific performance; for each party's case would be distinct, and would depend upon its own peculiar17 circumstances, and therefore there should be a distinct bill upon each contract; on the other hand, the vendor in the like case, would not be allowed to file one bill for a specific performance against all the purchasers of the estate, for the same reason.
