The State Council has issued the "Guide to Investment by Foreign Businesses" which aims at protecting investors2' interests. Recently, the State Development and Reform Commission and the Ministry3 of Commerce have revised the "Directory of Industries for Foreign Investment". According to the "Directory", China encourages foreign investors to participate in the exploitation, mining and processing of oil, natural gas, coalbed methane4, unconventional oil and gas resources, ferrous, and manganese resources. China limits foreign investors' participation5 in the exploitation and mining of special and rare types of coal resources, precious metals such as gold, silver, platinum6, diamond resources, phosphorus, heavy spar, boron and celestite resources. China also limits foreigners to make investment in the smelting7 of copper8, aluminium9, lead, zinc10, tungsten, molybdenum, tin, antimony, and the smelting of rare earth resources. For each different kind of mining resources that are put under the “encouraging” or “limiting” categories, the regulation makes it clear in the stipulations on what forms of foreign investment should make in exploring these resources and how many shares Chinese companies should take in the exploring. In addition, China forbids foreign investors to participate in the exploitation and mining of tungsten, molybdenum, tin, antimony, and fluorite resources, and in the exploitation, mining and processing of rare earth resources. China also forbids foreign investors to take part in the exploitation, mining, smelting and processing of radioactive mining resources, Wang said.
In future, Chinese government will explore its mining resources by abiding11 by the principles of relying mainly on domestic companies, carrying out cooperation with foreigners based on mutual12 benefits, strengthening exploring capabilities13, extensive exploring, exploring with conservation, rational utilization14, standardizing15 management and promoting social harmony. In future, China will aim at setting up an operational scheme and conservation management scheme in the mining industry that observes market rules so that China's mining industry can develop in a way that is resources-efficient, safe, sustainable and pollution-free, he noted16.
